PAYMENTS AND DEPOSITS

 

Your minimum coverage includes at least one investment package. If additional time is needed for the initial investment, it can be added upon request. Please note that the deposit specified on your invoice is non-refundable, as we reserve that day specifically for your event. All payments are to be made before or on specified dates on the final invoice. The final payment must be made 4 weeks after the wedding date or before the product delivery, whichever comes first.

 

TERMS & CONDITIONS

 

This document contains the entire agreement and full understanding between EVERGREEN VISUALS PTY. [hereby referred to as “EV PTY.”] and wedding clients [hereby referred to as “Clients”]. This is a legal binding document ensuring the business of wedding photography. The content of this executed agreement is not subject to change until the date of the wedding unless evaluated and changed by EV PTY. and Clients through the completion of a separate contract after the former has been voided.

 

RESERVATION

 

In order to reserve EV PTY. for the date of a wedding, Clients must sign this agreement and pay a non–refundable (up to) 40 percent(unless otherwise discussed) retainer of the total cost of the wedding coverage services. By signing this agreement, Clients agree to be legally obligated to all the terms herein. This agreement is only valid upon its execution by EV PTY. Clients shall each be jointly and severally liable under this agreement for the obligations of Clients hereunder.

 

ARTISTIC STYLE

 

Clients acknowledge and agree that EV PTY. maintains the discretion to determine and retain the final say over the services that will be provided, including posing, lighting, camera and lens selection, among others. Clients acknowledge and are familiar with EV PTY.'s portfolio and stylistic preferences but also understand that artistic work continually evolves and may differ from past work by EV PTY. In creating the final product for Clients, EV PTY. reserves the right to make artistic choices that remain within the agreed-upon services and terms.

 

IMAGE SELECTION PROCESS + EDITING

 

Upon completion of the shoot day services and the wedding date, the photos and footage produced will undergo a careful selection process by EV PTY. This process may last up to two months. No product requests will be accepted before or during this two-month editing period. EV PTY. reserves the right to strategically choose the most suitable media to be edited and delivered to Clients. All culling and editing will be under the complete control and authority of EV PTY. Please note that EV PTY. cannot guarantee a specific minimum number of photos to be delivered to Clients. Any requests for product changes received more than two weeks after delivery will incur additional charges.

 

RAW MEDIA

 

Under no circumstances will EV PTY. allow the delivery of RAW media to Clients. All delivery of digital products will be in .jpeg and .MP4 format via online delivery.

 

MEDIA ARCHIVING

 

EV PTY. will remove all RAW media files 12 months following the delivery of the final edited files to Clients. Once the media files have been provided to Clients via online delivery, it is the Clients' responsibility to store the delivered data in various locations to ensure the safety of all edited files.

 

LOST ITEMS

 

EV PTY. is not responsible for items lost by Courier or Invalid addresses on contact forms.

 

LOCATION ACCESS, FEES, AND PERMITS

 

In the event that Clients decide to shoot at a location that charges for access and/or requires a permit for photography and filming, Clients will be responsible for all associated fees, including but not limited to entrance fees and parking charges. Additionally, Clients will be responsible for arranging access to the location and obtaining any necessary permits for the shoot.

 

EXCLUSIVITY

 

Unless otherwise agreed upon beforehand, EV PTY. and any contracted professional photographer[s] and/or filmmaker[s] will be the sole professionals photographing and/or filming on the day of the wedding, if they have been hired for the event.

 

SUBSTITUTION

 

In the unlikely event that EV PTY. and/or contracted professional photographers are unable to fulfill the responsibilities outlined in this agreement due to circumstances beyond their control, such as illness, death, fire, act of God, or any other unforeseeable event, the following provisions shall apply: EV PTY. will arrange for [1] a replacement professional photographer or [2] an adjustment to the fee amount or the scope of services chosen by Clients. If Clients decide not to accept the substitution offer, they may choose to terminate the agreement, subject to the following: EV PTY. will refund all payments made by Clients, including a full refund of the retainer.

 

MEALS

 

As part of the wedding day services, EV PTY. requires at least one meal to be provided for all EV PTY. photographers and/or filmmakers. Please ensure that our meals are not served last, as we will not be able to eat during formalities.

 

COPYRIGHT

 

All digital edits shall remain the exclusive copyrighted property of EV PTY. to be used both publicly and privately. This copyright includes but is not limited to online use.

 

WEDDING DATE CHANGE

 

If Clients decide to terminate or change the date of the wedding after signing this agreement, the original retainer agreed upon will be applied to the new date, provided that it is available. However, if the rescheduled date is not available for EV PTY. to provide wedding coverage, the agreed upon retainer will not be refunded, and this contract will be terminated. It is the sole responsibility of Clients to ensure that EV PTY. is available on the new wedding date. EV PTY. will not be held responsible for any changes to the wedding date made by Clients.

 

COOPERATION

 

Both parties agree to maintain a cheerful and cooperative relationship, with open communication to achieve the best possible outcome as defined by this agreement. This includes cheerful cooperation and communication before, during, and after the Clients’ wedding. Clients acknowledge that EV PTY. maintains a busy schedule before and after their wedding, which may include other clients' projects.

 

HARASSMENT

 

Clients, its hired contractors, and any other persons present at Clients’ wedding are expected to maintain a respectful and professional conduct towards EV PTY.. EV PTY. will not tolerate any form of harassment, including verbal, physical, or sexual, from Clients, their associates, guests, vendors, or any other person. In the event of any harassment, EV PTY. and/or its hired contractors will discuss the situation with Clients to seek a resolution. However, if the situation cannot be resolved, EV PTY. reserves the right to terminate their services and will not be liable to reimburse any fees paid by the Client.

 

PRODUCT DELIVERY

 

We love to et everyone see your final products, but your products will be exclusively delivered to you, the couple, and we kindly request that friends and family members refrain from requesting the product directly from EV PTY. Unless arrangements have been made otherwise, the product will only be delivered to the couple

 

CREATIVE RELEASE

 

EV PTY. will document the events based on the prior communication with the couple and will strive to act in the best interest of capturing the essence of the Clients’ events while preserving EV PTY.'s creative vision. While EV PTY. will make every effort to capture moments as they unfold, EV PTY. cannot guarantee specific images and clips or complete coverage.
